La voluntad fundacional como motor de su funcionamiento

    En toda creación de una Fundación es fundamental la voluntad del fundador. Es clave para su existencia, por lo que en este trabajo analizamos dicha voluntad, distinguiendo tres momentos en la vida de toda Fundación: su constitución, su funcionamiento, y su extinción. Voluntad que se refleja en los estatutos fundacionales siendo el motor de actuación al amparo de su patronato y supervisado por el protectorado, voluntad que tiene ciertos límites que hay que vigilar sin perjuicio del reconocimiento beneficioso en nuestra sociedad. De ahí la necesidad de abarcar fines de interés general en favor de colectividades genéricas de personas.

    In all creation of a foundation, the will of the founder is fundamental. It is key to its existence, so in this work it is intended to always protect and maintain this will, distinguishing three moments in the life of any foundation: in its constitution, in its operation, at its extinction. Will that is reflected in the founding statutes being the driving force of action under the protection of its patronage and supervised by the protectorate, will that has certain limits that must be monitored without prejudice to the beneficial recognition in our society, hence the need to cover interests of interest general in favor of generic collectivities of people.
