En el Proyecto de Ley de reforma del texto refundido de la Ley Concursa!, en relación con la suspensión de ejecuciones en el «preconcurso», se mantiene básicamente el régimen actual, si bien se le da más flexibilidad. Además, en el contexto de un plan de reestructuración y por el efecto del arrastre de acreedores por clases, se establecen una serie de normas en aras a alcanzar un equilibrio entre el interés colectivo en reestructurar una empresa viable y el derecho individual del acreedor con garantía a realizar su valor al margen del plan. En el ámbito del proceso concursal, se paralizan las ejecuciones y apremios en trámite, si bien podrán continuar las ejecuciones laborales o apremios administrativos en que se hubieran embargado bienes o derechos del deudor (declarados no necesarios para su actividad por el juez del concurso). Las ejecuciones de garantías reales no se pueden iniciar o se suspenden sean los acreedores garantizados, acreedores concursales o no.

n the Draft Law amending the consolidated text of the Bankruptcy Law, in relation to the suspension of executions in the «pre-bankruptcy», the current regime is basically maintained, although it is given more flexibility. In addition, in the context of a restructuring plan and because of the effect of class carry-over of creditors, a number of rules are established in order to strike a balance between the collective interest in restructuring a viable enterprise and the individual right of the secured creditor to realize its value outside the plan. In the field of bankruptcy proceedings, executions or enforcement proceedings are paralyzed, although labor executions or administrative constraints in which assets are rights of the debtor (declared not necessary far their activity by the bankruptcy judge) may continue. Enforcement of security rights cannot be begin or is suspended whether secured credítors are in bankruptcy or not.
