La “is-ought question” e l’interdipendenza descrittivo-normativo

    Dato che nelle più recenti indagini logiche viene esclusa la validità dell'inferenza Is-Ought, interessa capire che cosa stia alla base dei vari tentativi di giustificarla. La risposta è che gli esempi di solito addotti di tale inferenza si possono ricostruire esplicitando le premesse sottaciute del ragionamento, di solito costituite dai c.d. principii-ponte. L'esplicitazione delle premesse risulta anche un metodo appropriato per derelativizzare gli enunciati descrittivi rispetto alle teorie presupposte, con cui hanno peraltro un rapporto di interdipendenza. Nei paragrafi finali si discute la specificità del problema del rapporto tra descrittivo e normativo in ambito giudiziario.

    Given that in the most recent logical investigations the validity of the Is-Ought inference is excluded, it is interesting to understand what lies at the ground of the various attempts to justify it. The answer is that the seemingly sound examples of such inference which are usually proposed can be reconstructed by making explicit the tacit premises of the argument, which in the cases of interest take the form of so-called bridge-principles. It turns out that making the premises explicit is also an appropriate method for “derelativizing” descriptive statements with respect to presupposed theories, with which they are interdependent. In the final sections the focus is on the specificity of the relation between descriptive and normative in the field of law.
