    The European Court of Justice, as demanded twice to define the boundaries of the legal remedies within the issuing Stateof the European Investigation Order, which sets forth the search, seize and hearing of the witness through videoconference, designs an interpretation oriented to the protection of the fundamental rights, whose compliance to the domestic system is now called on.

    Richiesta per la seconda volta di definire i confini del diritto di impugnazione nello Stato di emissione dell’ordine europeo di indagine che dispone perquisizioni, sequestri e audizioni di testimoni mediante videoconferenza, la Corte di giustizia offre un’esegesi finalmente attenta alla tutela dei diritti fondamentali, per la cui osservanza l’ordinamento interno è ora chiamato ad attrezzarsi.
