    Starting from the analysis of the principles settled by European Court of Justice's case law in the matter of access to traffic and location data for purposes in the criminal field, the Author examines the repercussions on the Italian system of the judgment of the same Court in case C-746/18. H. K. Highlighted the contrasts between the national and European legislation on the subject, the contribution focuses on the consequences of such a contrast in the procedural field, also in light of the regulatory changes occurred with the adoption of the Legislative Decree 30 September 2021, n. 132.

    Partendo dalla disamina dei principi espressi in materia di acquisizione dei tabulati telefonici e telematici dalla giurisprudenza europea degli ultimi anni, l'Autrice analizza le ripercussioni sull'ordinamento italiano della sentenza della Corte di giustizia dell'Unione Europea del 2 marzo 2021, C-746/18, H.K. Dopo avere evidenziato i profili di frizione della normativa interna in materia con quella europea, il contributo si sofferma sulle conseguenze, sul piano processuale, di tale contrasto, anche alla luce delle modifiche normative introdotte dal d.l. 30 settembre 2021, n. 132.
