Resumen de La validez de la figura del criminólogo en el ámbito penitenciario

  Desde principios del siglo pasado, la Criminología ha estado presente en la Administración Penitenciaria. Sin embargo, desde la sustitución del “juristacriminólogo” por la figura del “jurista”, se han vetado las puertas de las instituciones penitenciarias a los criminólogos, a pesar de que en las normativas vigentes se evidencien claros conceptos y términos criminológicos. Se critica la efectividad y eficacia de las penas privativas de libertad en cuanto a la resocialización y reinserción social del delincuente (fin primordial de las sanciones penales), debido a una serie de carencias que caracterizan nuestro sistema penitenciario (principalmente la falta de personal y el hecho de dar prioridad a la seguridad frente a un adecuado tratamiento).

  Junto a ello, se analiza la influencia de las percepciones sociales hacia a los reclusos con el fin de observar la magnitud de tal influencia. La criminología, gracias a su visión holística, puede abordar estas cuestiones con el objetivo de reformar no sólo el sistema penitenciario, sino la visión social hacia el fenómeno criminal. Con todo, se evidencia una clara necesidad de la incorporación del criminólogo como especialista en la Administración Penitenciaria.

  Since the beginning of the last century, Criminology has been present in the Penitentiary Administration. However, since the substitution of the "juristcriminologist" for the figure of the "jurist", the doors of the penal institutions have been vetoed to the criminologists, in spite of the fact that in the current regulations clear concepts and criminological terms are evident. Criticizes the effectiveness and effectiveness of custodial sentences in terms of resocialization and social reintegration of the offender (the main purpose of criminal sanctions), due to a series of shortcomings that characterize our prison system (mainly the lack of personnel and the fact of giving priority to security versus proper treatment). Along with this, the influence of social perceptions towards inmates is analyzed in order to observe the magnitude of such influence. Criminology, thanks to its holistic vision, can address these issues with the aim of reforming not only the penitentiary system, but the social vision towards the criminal phenomenon. However, there is a clear need for the incorporation of the criminologist as a specialist in the Penitentiary Administration.
