Antes de la revolución francesa, la escuela del Derecho Natural racional establecía que la voluntad era la fuerza creadora del contrato, admitiendo que la sola voluntad individual provocaba la transferencia o constitución de los derechos reales. A la luz de esta filosofía la necesidad de un acto material para transferir algo ideal como el derecho de propiedad era injustificable mediante la razón. Entonces, ¿Cuál fue el fundamento que usaron los filósofos franceses para gestar una revolución en el caso particular de Francia? Esta interrogante determina el núcleo de este trabajo, que tiene como fin primordial demostrar la fuerte injerencia que tuvo la concepción de la propiedad como derecho fundamental e inspiración de una fórmula que permitió plantear un cambio en el orden social de principios del siglo XIV
Before the French Revolution, the school of rational Natural Law established that will was the creative force of the contract, admitting that individual will alone caused the transfer or generation of real rights. In light of this philosophy the need for amaterial act to transfer something ideal, as the right of property, was unjustifiable through reason. So, what was the base that the French philosophers used to create a revolution in the particular case of France? This question defines the primary nucleus of this work, whose main purpose is to demonstrate the strong interference that the conception of property had as a fundamental right and inspiration of a formula that allowed to propose a change in the social order of the early fourteenth century.
