En la primera parte de este trabajo se estudian los criterios generales para determinar si una opinión está amparada por el derecho a la libertad de expresión y la exigencia de que también el castigo de las expresiones prohibidas respete el principio de proporcionalidad. En la segunda parte, se analizan algunas sentencias recientes del Tribunal Constitucional y del Tribunal Europeo de Derechos Humanos que abordan aquellas cuestiones.
The first part of this paper examines the general criteria for determining whether an expressed opinion is protected by the right to freedom of speech and the requirement that also the punishment for prohibited expressions should respect the principle of proportionality. The second part analyses some recent judgments of the Constitutional Court and the European Court of Human Rights that address these issues.
