Mediante el análisis de un estudio de caso, se mostrarán las dificultades que cualquier investigador puede encontrar en la defensa y protección del patrimonio cultural y artístico español frente a instituciones oficiales. Las diferentes administraciones, loco-regionales, autonómicas y estatales están fracasando en las labores de protección del patrimonio cul tural en manos privadas, ya que las di+cultades económicas de aquellas, que van cronificándose, propician la destrucción, disociación y dispersión de lariqueza cultural de nuestro país. Al conjunto de signos y síntomas que su-fren los propietarios de este patrimonio, que emplean su tiempo vital en pre-tender que la administración lo reconozca y proteja, sin conseguirlo; se le haquerido denominar Síndrome de Margarito Duarte, en honor al personajede Gabriel García Márquez
By analyzing a case study, the dificulties that any researcher may encounter in the defense and protection of Spanish cultural and artistic heritage against the oficial institutions will be shown. The different administrations, loco-regional, regional and state, are failing to work on the protection of cultural heritage in private hands, since the economic dificulties of those who are becoming chronic, lead to the destruction, dissociation and dispersion of cultural wealth of our country. To the set of signs and symptoms suffered by the owners of this heritage, who spend their vital time in pretending that the administration recognizes and protects it, without achieving it; it has been called Margarito Duarte Syndrome, in honor of the character of Gabriel García Márquez
