La narcogasolina, un desafío para la seguridad pública. Actuación policial desde la perspectiva administrativa

    El presente artículo versa sobre la gasolina destinada a ser empleada como combustible para las “narcolanchas”. Esta gasolina bautizada como “narcogasolina”, además de ser una herramienta fundamental y, por ende, parte vital de la logística necesaria para el tráfico de hachís desde el norte de África, también es el origen de una serie de riesgos y peligros, en especial aquellos que afectan a bienes jurídicos tan importantes como la vida y la integridad física de las personas, así como nuestro propio hábitat, y por consiguiente el medio ambiente. Quiero con ello dar a conocer un estudio que, desde el análisis de normas legales, nos permita dar respuesta a una serie de interrogantes desde un enfoque eminentemente administrativo, consciente de que nuestro objeto de estudio puede llegar a formar parte del denominado “iter críminis”, sobrepasando así el ámbito administrativo e introduciéndose en el ámbito penal, cuestión esta que no es motivo del presente trabajo. El transporte, depósito y posterior tratamiento y/o destrucción de la gasolina destinada a ser empleada como combustible para las “narcolanchas”, genera una serie de cuestiones, en concreto, en el ámbito de las Fuerzas y Cuerpos de Seguridad, que afectan tanto a la seguridad de las personas como al medioambiente. Todo ello requiere respuestas que en el presente trabajo serán analizadas desde las Ciencias Policiales, con especial referencia al Derecho Administrativo.

    This article focus on the gasoline intended to supply the “narco-speedboats”. This gasoline named as “narcogasoline”, besides being a fundamental tool and thus a vital part of the needed logistic to the hashish trafficking from north of Africa, other than that, it is also the cause of risks and dangers, mainly, those which have an impact on legal assets so relevant such as human life and physical integrity, affecting as well our own habitat and thus the environment. The purpose is to make known a research, in which through the analysis of several legal regulations, it will be able to give solutions from an eminently administrative approach to a range of questions, being aware of the fact that our subject of study can be linked to the so called “iter criminis”, and thereby exceeding the administrative scope and reaching the penal-criminal field, which is not the objective of study in the current research. The transport, storage and subsequent treatment and/or destruction of the gasoline aimed at being used as fuel for the “narco-speedboats”, create a range of issues, in particular for the Law Enforcement Agencies, affecting the public safety as well as the environment. The aforementioned situation, requires solutions that in the current survey will be analysed from the police sciences perspective with particular reference to the administrative law.
