Resumen de Fianzas y avales públicos en el concurso del deudor garantizado

En relación con las líneas de avales canalizadas a través del Instituto de Crédito Oficial, se trata de determinar la posición que ostenta el Ministerio de Asuntos Económicos y Transformación Digital en el préstamo ICO-Covid., si aún no ha vencido el crédito y no se ha ejecutado el aval. En aplicación del art. 261.3 del Texto Refundido de la Ley Concursal, la ejecución o no del aval es determinante para la clasificación del crédito, pues éste permanece como crédito contingente sin cuantía propia (por estar sometido a la condición suspensiva consistente en el pago o impago por parte del deudor, aquí concursado, llegado el vencimiento del préstamo), hasta que el aval se ejecute.

In relation to the guarantee lines channelled through the Official Credit Institute, the question is to determine the position held by the Ministry of Economic Affairs and Digital Transformation on the ICO-Covid loan, if the credit has not yet expired and the guarantee has not been executed. In application of art. 261.3 of the Consolidated Text of the Insolvency Law, the execution or not of the guarantee is decisive for the classification of the credit, since this remains as a contingent credit without own amount (for being subject to the suspensive condition of payment or non-payment by the debtor, here entered into, after the maturity of the loan), until the guarantee is executed
