    Es importante y necesario realizar un redimensionamiento en la perspectiva crítica-reflexiva y jurídico-epistemológica en la concepción de los sistemas naturales biodiversos que han sido protegidos mediante decisiones jurisprudenciales, en un contexto del constitucionalismo ambiental democrático contemporáneo. Lo anterior desafía el paradigma filosófico del derecho civil e implica un cambio que se ha iniciado en la interpretación constitucional de los llamados derechos de la naturaleza, lo que lleva a la pregunta de ¿cómo proteger eficazmente a sujetos especiales no humanos en el constitucionalismo ambiental? Se propone la creación y estructuración filosófica de un nuevo concepto de reconocimiento de personalidad ontológica-jurídica.

    It is important and necessary to re-dimension the reflective critical perspective, and legal-epistemological in the conception of biodiverse natural systems that have been protected through jurisprudential decisions, in a context of contemporary democratic environmental constitutionalism. The notion of subject of rights is in a state of construction. This challenges the philosophical paradigm of civil law and implies a change that has begun in the constitutional interpretation of the so-called rights of nature. How to effectively protect special non-human subjects in environmental constitutionalism? The creation and philosophical structuring of a new concept of recognition of ontological-legal personality is proposed.
