    Este artículo analiza cómo los fundamentos que justifican la obligatoriedad del contrato -antecedente esencial en base al cual se estructura esta institución y que explica su protección jurídica- han incidido directamente en la evolución de noción de contrato desde la noción tradicional del acuerdo de voluntades entre las partes generadora de obligaciones respecto del deudor a mecanismo de colaboración entre contratantes para satisfacer intereses mutuos, basado en la autonomía de la voluntad; así como las implicancias de esta evolución en las herramientas que el ordenamiento jurídico otorga a las partes contratantes para reaccionar ante los incumplimientos.

    This article analyzes the fundamental justifications of the concept of binding force of contract. This is the essential factor on which the notion of contract is based and explains the protection provided by the laws governing this legal institution. It further examines how the evolution of this concept has affected the notion of the contract itself. Whereas the traditional notion of contract was an agreement of wills between the parties generating obligations with respect to the debtor, the current notion is based on a mechanism of collaboration between the parties to satisfy mutual interests. Finally, the article explains the important implications of this development especially in the tools that the legal system provides to the parties in case of breach of contract.
