  The article aims to analyze the brazilian regulation of the Receivables investment Funds, examining them in a functional perspective in order to delimit their own risks (“business risk”). in view of the function they perform and the risks connected to these entities, it seeks to outline the discipline of liabilities and duties attributed to their main agents, namely, the administrator and the manager. although focused on the discipline of brazilian law, it outlines, comparatively, the main differences with the legal regime of these entities in Portugal

  O artigo visa a examinar os Fundos de investimentos em direitos creditórios no brasil, examinando-os em perspectiva funcional a fim de delimitar os riscos que lhe são próprios (“risco próprio do negócio”).

  em vista das funções a que volvidos e dos riscos conectados a esses organismos, busca traçar a disciplina das responsabilidades e dos deveres imputados aos seus principais agentes, nomeadamente, o administrador e o gestor. embora centrado na disciplina do direito brasileiro, traça, comparativamente, as principais diferenças com o regime jurídico desses organismos em Portuga
