Resumen de Una lectura iusfilosófica de David Graeber sobre el sujeto, la deuda y la moral

Este artículo considera la relevancia de la obra de David Graeber, en particular de Debt, para la filosofía del derecho. Analiza su perspectiva del fenómeno jurídico y las implicaciones de sus nociones de deuda y sujeto de interés, con especial atención al efecto que han tenido sobre ellas los enfoques de austeridad. En segundo lugar, atiende a los conflictos axiológicos que se dan en el interior de nuestros ordenamientos sobre la primacía de la obligación de pagar las deudas y la distribución de responsabilidad y culpa entre los sujetos implicados. Para ello, tiene en cuenta también el tratamiento de la cuestión por parte del Tribunal Constitucional español. Por último, introduce algunas líneas de investigación posibles para la transformación del Derecho.

This paper considers the relevance of David Graeber's work, in particular Debt, for the Philosophy of Law. It analyzes his perspective on the legal phenomenon and the implications of his notions of debt and subject of interest. It focuses in particular on the effect that austerity approaches have had on them. Secondly, it attends to the axiological conflicts that emerge within our legal systems on the primacy of the obligation to pay debts and the distribution of responsibility and guilt among the subjects involved. To this end, it also considers the treatment of the question by the Spanish Constitutional Court. Finally, it introduces some possible lines of research for the transformation of Law.
