Los claroscuros del “non bis in idem” en el espacio jurídico europeo

    El presente trabajo destaca la amenaza de duplicidad punitiva en el espacio jurídico europeo y las dificultades para encontrar un criterio claro y pacífico que sirva para determinar el alcance y contenido del principio non bis in idem. Tras poner de manifiesto su reconocimiento normativo y los diferentes estándares de protección en los textos europeos y en el Derecho interno español, se analiza críticamente la jurisprudencia del TEDH y del TJUE, que se caracteriza no sólo por su casuismo y fragmentación, sino también por una errónea ampliación de la definición del elemento idem que está conduciendo a una peligrosa relativización del otro elemento de la prohibición: el bis. El estudio concluye con una sintética referencia al fundamento del non bis in idem, en el que subyacen algunos de los equívocos que han provocado esa situación.

    The following paper highlights the threat of punitive duplicity in the European legal framework and the difficulties in finding a clear and peaceful cri-terion that can be used to determine the scope and content of the non bis in idem principle. After highlighting its legal recognition and the different standards of protection in European Union legal texts and in Spanish domestic law, the juris-prudence of the ECHR and the CJEU is critically analyzed, which is characterized not only by its casuistry and fragmentation, but also by an erroneous extension of the definition of the idem component that is leading to a dangerous relativization of the other component of the prohibition: the bis. The analysis concludes with a brief reference to the foundation of non bis in idem, in which some of the misun-derstandings that have caused this problem lie
