    El presente trabajo se inspira en algunas decisiones judiciales recientes, en particular la Sentencia de la Corte de Bolonia (10 de marzo 2021) bajo la cual se ha reconocido la cancelación de perfiles digital sin justificación como causa para el reconocimiento del derecho a una indemnización por daños no patrimoniales (de conformidad con el artículo 2059 del Código Civil italiano), puesto que la cancelación del perfil digital se expresa sólo de manera genérica en los términos contractuales (o condiciones de uso) de la red social, con un riesgo evidente de abuso.

    The paper summarized in this abstract takes its cue from some recent court decisions, in particular the judgement of the Court of Bologna on March 10th , 2021, under which the event of the digital profile cancellation without justification has been recognized as cause to the right to a compensation for the non-patrimonial damage (according to the article 2059 of the Italian Civil Code), even though the digital profile cancellation is expressed only in a generic manner in the contractual terms (or conditions of use) of the social network, with an evident risk of abuse.
