The new modalities of financial transactions carried out by traditional banks ver-sus their counterparts in the virtual environment, which use bank and personal data of users, some of which are sensitive, in what is called open banking is the central theme of the work. This article investigates the following issue: the need to adapt open banking and the effective protection of users' personal data. Thus, we started from a general definition of the expression open banking, seeking to understand the current regulation proposal, declining its regulation at-tempt, to analyze its coupling with the LGPD. The study made use of bibliographical and docu-mentary research, with a dialectical approach, supported by the Economic Analysis of Law. It concludes that there is a need for an intervention by the regulatory agency (BACEN), balancing data protection and increased competition generated by the studied institute
