As regards “normal” criminals, since classical age there has been a need to provide different treatment to people who committed crimes because of their pathologies and mental problems. This is because insane criminals were not considered responsible for their behaviours. Likewise there was a need to protect society from these people potentially highly dangerous. For these reasons, in Italy at the end of the nineteenth century, with some delay behind some other countries, psychiatric prisons were set up. This was done by adopting models and paradigms coming from the psychiatric and legal sciences.
In 2012, according to the major Law n°9, psychiatric prisons were abolished and closed down. They had operated for about 150 years during which their existence and organisation structure were constantly the target of extensive and continuous discussions. Nowadays, despite their closure, their criticism carries on.
