    This article starts from a general overview of the most recent legal and political acquis of the European Union in the field of the protection of minors, to then focus on the importance of the principle of the best interests of the child and the need for its extensive interpretation in relation to the “Return Directive”, as underlined by the Court of Justice of the European Union in particular in case C-112/20, M.A. v. État belge, in order to determine whether a derived right of residence should be granted to a third-country national who is the father of a minor child who is a citizen of the European Union.

    Il presente contributo prende avvio da una panoramica generale sul più recente acquis giuridico e politico dell’Unione europea in materia di tutela dei minori di età, per poi soffermarsi sull’importanza del principio dei best interests of the child e sulla necessità di una sua interpretazione estensiva in relazione alla “Direttiva rimpatri”, come sottolineato dalla Corte di giustizia dell’Unione europea in particolare nella causa C-112/20, M.A. c. État belge, al fine di determinare se un diritto di soggiorno derivato debba essere concesso a un genitore cittadino di un Paese terzo di un minore di età cittadino dell’Unione europea.
