    From taxation as a common element of the economic and fiscal crises in the COVID-19 pandemic, the work addresses the function of the tax in the Fiscal State and presents considerations from the theory of values that may indicate the solution of the established conflict. At the end, a brief judgment that faces the problem is presented, pointing out the use of the elements worked in the text, concluding that in the clash between the economic crisis suffered by some enterprises and the incidence of taxation, this is hierarchically superior under the assumption that or the way in which the State raises resources to face the public health crisis.

    A partir da tributação como elemento em comum das crises econômica e fiscal na pandemia de COVID-19, o trabalho aborda a função do tributo no Estado Fiscal e apresenta considerações a partir da teoria dos valores que possam indicar a solução do conflito estabelecido. Ao final é apresentado brevemente julgado que enfrenta a problemática, apontando-se a utilização dos elementos trabalhados no texto, concluindo que no embate entre a crise econômica sofrida por alguns empreendimentos e a incidência da tributação, esta se mostra hierarquicamente superior sob o pressuposto de que seja a forma como o Estado carreia recursos para o enfrentamento da crise de saúde pública.
