El nuevo apartado 8.º del artículo 92 del Código Civil, introducido por la Ley Orgánica 8/2021, de 4 de junio, de protección integral a la infancia y la adolescencia frente a la violencia, afirma que el juez a instancia de una de las partes, con informe del Ministerio Fiscal, podrá acordar la guarda y custodia compartida fundamentándola en que solo de esta forma se protege adecuadamente el interés superior del menor. Pues bien, existe una corriente jurisprudencial en la Audiencia Provincial de Tarragona que señala la posibilidad de que el juez, en interés superior del menor, otorgue dicho tipo de custodia compartida, aun habiendo sido condenado el progenitor por un delito de violencia contra la madre, concretamente un delito de maltrato de obra atenuado sobre la mujer, y, en otro caso, por un delito de acoso. Contrariamente, la jurisprudencia del Tribunal Supremo entiende que no cabe este tipo de custodia cuando las relaciones entre los litigantes se encuentran muy gravemente deterioradas, ya que incluso la actora ejercita la acción penal contra el que fue su marido en el procedimiento criminal seguido contra su persona, por lo que la custodia compartida en las relaciones entre los progenitores con respecto al cuidado y atención de los menores es de muy mal pronóstico.
The new section 8 of article 92 CC, introduced by Organic Law 8/2021, of June 4, on comprehensive protection of children and adolescents against violence, affirms that the Judge at the request of one of the parties, with a report from the Public Prosecutor’s Office, may agree to joint custody and custody on the basis that only in this way is the best interest of the minor adequately protected. Well, there is a jurisprudential trend in the Tarragona Provincial Court that indicates the possibility that the Judge, in the best interests of the minor, grant said type of joint custody, even though the parent has been convicted of a crime of violence against the mother, specifically a crime of mistreatment of work attenuated on the woman, and, in another case, by a crime of harassment. On the contrary, the jurisprudence of the Supreme Court understands that this type of custody does not fit when the relations between the litigants are very seriously deteriorated, since even the plaintiff exercises criminal action against her husband in the criminal procedure followed against her person, therefore, the shared custody with respect to the care and attention of the minors is of a very poor prognosis.
