Resumen de La hipoteca mobiliaria sobre los derechos de propiedad industrial

En este artículo se examina la Ley de hipoteca mobiliaria y prenda sin desplazamiento en lo relativo a la propiedad industrial. En primer lugar, se argumenta la importancia de los diferentes registros que intervienen en la vida de una hipoteca mobiliaria sobre propiedad industrial y se estudian las particularidades que presenta el objeto de la garantía real, incluidas las cuestiones de la valoración. En segundo lugar, se analiza la situación en Derecho comparado y en el marco de las organizaciones internacionales como UNCITRAL y los Principios CLIP para plantear cómo podría modernizarse el sistema a través del régimen jurídico. Finalmente, se detectan insuficiencias de orden legislativo en el sistema español de la hipoteca mobiliaria sobre derechos de propiedad industrial que deberían ser objeto de reforma.

This article examines the law of chattel mortgage and pledge without possession in relation to industrial property. First, the importance of the different registries that intervene in the life of a chattel mortgage over intellectual property is argued and the particularities presented by the object of the security right are studied, including some questions of valuation. Second, the situation in comparative law and under the framework of international organizations such as UNCITRAL and the CLIP Principles is analyzed in order to propose how the system could be modernized through the governing law. Finally, some deficiencies of legislative nature are detected in the Spansh system of chattel mortgage over intellectual property rights that should be subject to reform
