Resumen de Posibilidades de atribución de la vivienda familiar ocupada gratuitamente y de titularidad ajena

En el presente trabajo analizamos las posibilidades de atribución del uso de la vivienda familiar tras las crisis matrimoniales cuando la vivienda que ocupa la familia no es propiedad de uno o de ambos cónyuges, sino que están ocupándola en virtud de diferentes títulos. Se parte de una situación de propiedad ajena, contextualizando dicho planteamiento en nuestra actual realidad familiar, social y económica en las que muchas familias no pueden acceder a la compra y tenencia en propiedad de una vivienda y ante una falta de previsión legal expresa en el art. 96 CC de estas situaciones. De manera concreta, se examinan cuatro supuestos, a nivel doctrinal y jurisprudencial, respecto a la atribución de la vivienda familiar: cuya titularidad es de uno de los cónyuges y a su vez de un tercero ajeno al matrimonio, cuando la misma sea usufructuada, cuya atribución se realice por derecho de habitación o cuando la misma sea ocupada por razón del puesto de trabajo

This piece analyses the possibilities of attributing usage of the family residence in the wake of marital crises when the home occupied by the family is not in fact owned by one or both spouses, who instead are occupying it under different titles. The study begins by examining third-party property, an approach that is placed in the context of current family, social and economic realities in which many families are unable to purchase and possess their own home and in the light of the lack of legal provision with regard to such cases set out in article 96 of the Civil Code. Four specific cases regarding the attribution of the family residence are examined in legal and case-law terms: when the property is owned by one of the spouses and in turn by a third party outside the married couple, when it is usufructuary in nature, when its attribution is carried out by right of occupancy or when it is occupied on account of a job.
