Resumen de Principio de proporcionalidad y deberes de colaboración de los intermediarios en el mercado electrónico europeo

  El principio de proporcionalidad viene a desempeñar un papel fundamental en la identificación de los diferentes intereses confluyentes en mercado electrónico europeo, y especialmente en lo que se refiere al papel del intermediario como actor neutral mediante el desarrollo de una visión ponderativa entre el conocimiento sobre un hecho ilícito cometido por un tercero y la reacción esperada, justificando con ello un deber de colaboración a través de dos pasos fundamentales tomando. El primero tendría como finalidad identificar qué bien jurídico tiene la capacidad de justificar la imposición de un deber de colaboración en los intermediarios y por qué una lesión en ese bien jurídico debería ser evitado. El segundo paso, dividido a su vez en un deber objetivo de colaboración que tendría como objetivo examinar la magnitud de la lesividad en el bien jurídico protegido y justificar por qué el intermediario está obligado a evitar este daño, y el deber subjetivo de colaboración, el cual vendría vinculado a la necesidad del conocimiento del hecho ilícito cometido por terceros mediante el respeto a las garantías básicas del principio de contradicción.

  The principle of proportionality plays a fundamental role identifying the different interests in the European electronic commerce, especially regarding the neutral position of internet service providers. By the development of a balanced approach between the intermediary’s knowledge of the wrongful act and the reaction that should be expected, a duty of collaboration on intermediaries is justified and divided into two fundamental parts. The first one would aim to identify which legally protected interest has the capacity to justify the imposition of a duty of collaboration on intermediaries and why the damage to that legally protected interest should be avoided. The second step, divided into an objective duty of collaboration with the aim of examining the magnitude of the damage in the protected legal interest and justifying why the intermediary is obliged to avoid it, and the subjective duty of collaboration which will require the respect of the due process guarantees to prove the internet service providers’ knowledge of the wrongful act committed by third parties.
