    El presente estudio tiene como objetivo profundizar en el supuesto de hecho de la sentencia del TJUE de 19 de noviembre de 2020 para analizar si existe, en primer lugar, la sustracción de un menor desde la óptica del Convenio de la Haya de 1980 sobre los aspectos civiles de la sustracción internacional de menores y/o un delito de sustracción internacional de menores y, en segundo lugar, si verdaderamente la redacción del artículo 235 (2.2.) del Código penal alemán, que regula la sustracción de menores, es susceptible de restringir el derecho a la libre circulación de los ciudadanos comunitarios, o constituir una discriminación entre los nacionales alemanes y el resto de los nacionales comunitarios.

    The objective of this study is to analyze the factual situation of the CJEU judgment of 19 November 2020, in order to examine whether there is, firstly, child abduction from the perspective of the 1980 Hague Convention on the Civil Aspects of International Child Abduction, and/or a child abduction offence, and, secondly, whether the wording of Article 235 (2.2) of the German Criminal Code regulating child abduction is indeed likely to restrict the right to free movement of EU citizens, or to constitute discrimination between German nationals and other EU nationals.
