Los Derechos Humanos como principio inspirador de la política exterior de España: el visado humanitario

    La crisis de los refugiados de 2015 y la crisis de Afganistán de 2021 han vuelto abrir el debate sobre el cumplimiento por parte de la UE y sus EEMM con los compromisos asumidos en materia de Derechos Humanos. En este sentido, las competencias de la UE en materia de visados, migración y asilo están subsumidas dentro del ELSJ. Por otro lado, se ha sugerido doctrinalmente que tanto el VTL como el visado de tránsito aeroportuario se conviertan en permisos humanitarios. En el ámbito nacional, se ha exigido también una aplicación más proactiva de la previsión contenida en el artículo 38 de la Ley 12/2009. Sin embargo, el debate no debería centrarse en crear nuevos permisos o en reconducir los ya existentes. Puesto que ambas soluciones se han utilizado cuando los Estados así lo han querido. De esta manera, la decisión sobre los visados humanitarios no es tanto una cuestión de técnica jurídica sino más bien de voluntad política.

    The 2015 refugee crisis and the 2021 Afghan crisis have reopened the debate on how the EU and its Member Sates are fulfilling their commitments on Human Rights. In this regard, the EU has taken its responsibilites on visas, migration and asylum under the umbrella of the Area of Freedom, Security and Justice. On the other hand, several scholars have suggested that both the LTV and the airport transit visa should become humanitarian permits. Regarding the Spanish legal framework, it has been required a more proactive application of section 38 of the 12/2009 Act. However, the debate should not focus on creating new permits or redirecting the existing ones. Since both solutions have been used whenever the States have decided to do so. In this way, the decision on humanitarian visas is not so much a matter of legal technique but rather of political will.
