Resumen de Las mancomunidades de municipios en España: Un balance de 35 años

  Este artículo realiza un balance sobre los últimos 35 años de aplicación de la Ley básica 7/1985 en materia de Mancomunidades y, en particular, analiza los posibles factores que han influido en el proceso de reducción de las Mancomunidades de Municipios en España de los últimos ocho años. A tal fin, estudiamos los antecedentes de estos entes de asociación supramunicipal, sus ventajas e inconvenientes, su marco jurídico y los posibles problemas que plantean su constitución. Sigue abierto en España el debate entre quienes invocan la necesidad de eliminar la duplicidad entre Administraciones públicas y cumplir las normas sobre sostenibilidad financiera y estabilidad presupuestaria, y quienes consideran que las Mancomunidades de Municipios integran más adecuadamente el territorio, promueven economías de escala y garantizan la supervivencia de pequeños municipios fruto de las políticas sobre entidades locales supramunicipales diseñadas y financiadas por las Comunidades Autónomas y Diputaciones Provinciales

  This article offers a general reflection on the last 35 years of application of the Law 7/1985 in the field of the Commonwealths of Municipalities and discusses the possible factors that have influenced the process of reducing municipality commonwealths in Spain over the past eight years. To this end, we examine the background of these supra-municipal association bodies, their advantages and disadvantages, their legal framework and the possible problems posed by their constitution. The debate remains open in Spain between those who invoke the need to eliminate duplication between public administrations and comply with the rules on financial sustainability and budgetary stability, and those who consider that the Commonwealths of Municipalities more appropriately integrate the territory, promote economies of scale and guarantee the survival of small municipalities resulting from policies on local supramunicipal entities designed and financed by the Autonomous Communities and Provincial Councils
