La reforma de las pensiones: el nuevo marco legal de la jubilación

    El presente estudio aborda el nuevo marco regulador de la jubilación, en cuanto que eje principal de las reformas incorporadas en el marco de la Seguridad Social por la Ley 21/2021, de 28 de diciembre. Así, se analizan las medidas relacionadas con la prolongación de la vida laboral de las personas trabajadoras que cumplen la edad de jubilación. En particular, las relacionadas con cotizaciones a partir del cumplimiento de la edad de jubilación y en supuestos de compatibilidad de jubilación con trabajo, y las reformas incorporadas al régimen de jubilación activa. Se examinan, además, los aspectos críticos y se realizan propuestas de lege ferenda en relación con las modificaciones del marco legal de la jubilación anticipada: por razón de actividad, de personas con discapacidad, “voluntaria” e “involuntaria”. Junto a ello, se aborda lo que se ha denominado “nueva” jubilación forzosa, y en particular, las novedades incorporadas por la creación de lo que en este estudio se ha denominado jubilación forzosa “excepcional”, en comparación con la jubilación forzosa “general”. Por último, se sistematizan los aspectos problemáticos respecto de la suficiencia y revalorización de las pensiones de jubilación, y la compleja regulación de la “subida” de las pensiones bajas o de personas trabajadoras con largos periodos de cotización, así como la forma de financiación de las medidas vinculadas a la jubilación.

    This article addresses the new regulatory framework for retirement, due to the fact that this is the main axis of the reforms of the Social Security System in the Spanish Law 21/2021, december 28th. The article analyzes the measures related to the extensión of working life of people who have reached the retirement age. In particular, those related to Social Security quotes after reaching retirement age in cases of compatibility of retirement pensions and working life, and the reforms incorporated into the active retirement regime. In addition, the critical aspects of the reform are examined, giving lege ferenda proposals in relation to the modifications of the legal framework of the diferent early retirement modalities: due to activity, people with disabilities, “voluntary” and “involuntary” retirement. Along with this, what has been called in this article “new” forced measures of retirement is adressed. In particular, the novelties incorporated by the creation of what in this article has been called “exceptional” forced retirement, compared to “general” forced retirement”. Finally, the problematic aspects regarding the sufficiency and revalutation of retirement pensions are systematized, and the complex regulation of the “rise” of low pensions or for workers with long Social Security contribution periodos are examined in detail, as well as the ways of financing measures related to retirement.
