El estudio del fundamento de la costumbre nos revela algunas características específicas del derecho canónico y pone de manifiesto un cierto desajuste entre los requisitos legales de la costumbre y su naturaleza jurídica, parcialmente corregido en el Código de 1983, cuando descarta la doctrina de Suárez sobre la adprobatio legislatoris como esencia de la costumbre y reconoce que la communitas es el sujeto activo. Existen algunos requisitos de la costumbre que dependen de aquella concepción suareciana y que no fueron corregidos en el nuevo Código. Por ello, el estudio realiza un análisis del fundamento de la costumbre para comprender mejor este tipo de fuente normativa e iluminar una posible reforma que permita una adecuación entre la naturaleza de la costumbre y su régimen legal. Además, el autor ha querido contrastar el fundamento propuesto con algunos ejemplos de costumbres canónicas y actuales, y así mostrar de qué modo actúa la teoría sobre la costumbre en la vida práctica de la Iglesia.
The study of the basis of custom reveals some specific characteristics of canon law and reveals a certain mismatch between the legal requirements of custom and its juridical nature, partially corrected in the 1983 Code, when it discards the doctrine of Suarez on the adprobatio legislatoris as the essence of custom and recognizes that the communitas is the active subject. There are some requirements of custom that depend on that Suaretian conception and that were not corrected in the new Code. For this reason, the study carries out an analysis of the basis of custom in order to better understand this type of normative source and to illuminate a possible reform that would allow an adequacy between the nature of custom and its legal regime. In addition, the author has sought to contrast the proposed foundation with some examples of canonical and current customs, and thus show how theory acts on custom in the practical life of the Church.
