    La reciente jurisprudencia del Tribunal Constitucional español ha limitado el alcance del control judicial de los laudos arbitrales. Es una doctrina adecuada para respetar la autonomía de voluntad de las partes y la intervención judicial limitada, claves para el fomento del arbitraje. No obstante, debiera ponderarse en función de si la parte ha actuado debidamente defendida con abogado. De otro modo, muy particularmente si una de ellas es más débil, como sería el caso de los consumidores, se justifica un control de oficio más amplio. Lege ferenda, habría que extender la asistencia jurídica gratuita a los arbitrajes de consumo, lo que reduciría la necesidad de la protección de oficio.

    The recent jurisprudence of the Spanish Constitutional Court has limited the scope of ex officio judicial control of arbitration awards. It is an adequate doctrine to respect the agreement signed between the parties and to limit any court intervention, crucial to promote the arbitration. Howewer, this doctrine should be weighed according to whether if the party has been defended by a lawyer or not. Otherwise, very particularly if one of the parties is weaker, as would be the event of consumers, then a more extensive ex officio judicial control is justified. Lege ferenda, free legal assistance should be extended to consumer arbitrations, which would reduce the need for ex officio judicial protection.
