Administration of seized assets and execution of confiscation are issues that have long been neglected in the context of criminal proceedings. The aim of the reform is, first, to devise an organic discipline for the dynamic management of seized assets; the formulated directive, however, does not shine clearly, as it assumes as an archetype for the reform the norm that regulates the matter today (art.104-bis disp. att. c.p.p.). About the execution of the confiscation, the intentions are, on the contrary, more circumscribed. In the event of confiscation of equivalent value not preceded by seizure, the aim is to assimilate the executive forms to those governing the collection of the financial penalty. In the event that it is necessary to proceed with the sale, the purpose is to allow the delegation of operations. It will be up to the delegated legislator to evaluate the implications of those choices, identifying regulatory solutions that do not feed predictable interpretative disputes.

Amministrazione dei beni sequestrati ed esecuzione della confisca sono temi a lungo trascurati nel contesto processuale. Obiettivo della legge delega, quanto a gestione dinamica dei cespiti appresi, è congegnare una disciplina organica, seppur attraverso un criterio direttivo che, assumendo ad archetipo proprio la norma (art. 104-bis disp. att. c.p.p.) che oggi regola la materia, non brilla in chiarezza. Riguardo alle modalità esecutive della misura ablativa, gli intenti sono più circoscritti: in caso di confisca per equivalente non preceduta da sequestro, assimilarle a quelle che governano la riscossione della pena pecuniaria; quando occorra procedere alla vendita, consentire la delega delle operazioni. Spetterà al legislatore delegato cogliere i risvolti delle scelte compiute, individuando soluzioni normative che non alimentino i prevedibili contenziosi interpretativi.
