    On the basis of a technological system wich has become more accessible in the modalities of fruition and less onerous economically, the enabling statute promotes, in the name of a greater efficiency and acceleration of the trial times, the enlargement of the hypotheses of videorecording of the acts and of remote partecipation in the process. Beyond the suggestions evoked by the “digital rite”, any type of prediction on the choices made in this sense, cannot be separated from the consideration of the impact that they will have on the taking of evidence and on the principles that inspire it. The scenario on horizon is not reassuring.

    Sulla base di un sistema tecnologico divenuto più accessibile nelle modalità di fruizione e meno oneroso economicamente, la legge-delega promuove, nel nome di una maggiore efficienza ed accelerazione dei tempi processuali, l’ampliamento delle ipotesi di videoregistrazione degli atti e di partecipazione a distanza al procedimento. Aldilà delle suggestioni evocate dal “rito digitale”, qualunque tipo di pronostico sulle scelte compiute in tal senso, non può prescindere dalla considerazione dell’impatto che eserciteranno sulla formazione della prova e sui principi che la ispirano. Lo scenario all’orizzonte non è rassicurante.
