    El objetivo del presente artículo es analizar y cuestionar, desde el concepto de modernidad, cómo el sistema de patentes ha agudizado los impactos tanto social como económico adversos que se han vivido con la pandemia del SARS-CoV-2 desde diciembre de 2019. Se revisa el papel que han jugado las empresas biofarmacéuticas en el mercado internacional de vacunas y del sistema de propiedad intelectual asociado. Finalmente, en el caso específico de México analizaremos la evolución del sistema de propiedad intelectual y cómo la vacunación ha sido un proceso que, si bien ha ido avanzando de acuerdo con los criterios del tipo de sector y edad, va lento, por lo que persisten los contagios y la letalidad, y el interés privado prevalece sobre el bienestar social.

    The aim of this article is to use the concept of modernity to analyze and question how the system of patents has sharpened the adverse social and economic impacts of the SARS-CoV-2 pandemic since December 2019. The authors review the role played by bio-pharmaceutical companies in the international vaccine market and the intellectual property system associat-ed with it. Finally, in the specific case of Mexico, they analyze the evolution of the intellectual property system and how vaccination has been a process that, while it has moved ahead using criteria based on sectors and age, continues to be slow, and there fore contagion and death rates continue to exist and private interests continue to prevail over social well-being.
