  Resumen En el presente comentario analizamos el caso Servicio Nacional del Consumidor con Inmobiliaria Francisco de Aguirre Limitada, en particular las sentencias de la Corte de Apelaciones y de la Corte Suprema con ocasión del conocimiento de un recurso de apelación y, posterior, casación en el fondo; las cuales versaron sobre el ámbito de aplicación de la Ley n.° 19496 sobre Protección de los Derechos de los Consumidores. Para ello, y luego de resumir de manera breve los hechos, expondremos el problema jurídico que aparejan los conceptos de calidad y seguridad y su relación con la normativa aplicable. A su vez, expondremos los argumentos de la Corte de Apelaciones y la Corte Suprema al respecto, con la consideración especial del voto disidente de la abogada integrante Claudia Chaimovich en torno a distinguir los derechos de seguridad de la calidad de una vivienda dentro de la relación de consumo. Con ello, pretendemos lograr una adecuada comprensión de las materias excluidas de la ley y de la distinción entre los derechos que resguarda la misma.

  Abstract The present commentary analyses the case Servicio Nacional del Consumidor con Inmobiliaria Francisco de Aguirre Limitada, in particular the judgments of the Court of Appeals and the Supreme Court on the occasion of the hearing of an appeal and, later, cassation on the merits; which dealt with the scope of application of Law No. 19,496 on the Protection of Consumer Rights. To this end, and after briefly summarizing the facts, we will explain the legal problem posed by the concepts of quality and safety and their relationship with the applicable regulations. In turn, we will present the arguments of the Court of Appeals and the Supreme Court in this regard, with special consideration of the dissenting vote of the Member Attorney Ms. Chaimovich on distinguishing the rights of safety from the quality of housing within the consumer relationship. With this, we intend to achieve an adequate understanding of the matters excluded from the law and the distinction between the rights it protects.
