    En la presente investigación se planteó como objetivo general analizar jurídicamente la trata de personas y la explotación de las victimas por su condición de migrante extranjera, en Perú. Desde el paradigma cuantitativo, se plantea una investigación de tipo documental-bibliográfico, analizando jurídicamente documentos legales, antecedentes, tesis, trabajos arbitrados, con el objeto de formar el cuerpo teórico relacionado al tema. Para ello el procedimiento metodológico correspondiente desde la evaluación del problema, efectuándose subsiguientemente la interpretación correspondiente, hasta darse con el establecimiento de los precedentes necesarios que determinen la causalidad y sus consecuencias. Se aplicó un cuestionario a 6 Jueces Penales, Fiscales Penales, 5 Abogados Especializados en lo Penal y 9 Efectivos Policiales Especializados en investigación de delito de Trata de Personas. Se concluye que la trata de personas afecta y viola gravemente los Derechos Humanos, que generalmente perturba en su mayoría a las mujeres, dado a que son las más propensas.

    The general objective of this research was to legally analyze human trafficking and the exploitation of victims due to their status as foreign migrants in Peru. From the quantitative paradigm, a documentary-bibliographic type investigation is proposed, legally analyzing legal documents, antecedents, theses, refereed works, in order to form the theoretical body related to the subject. For this, the corresponding methodological procedure from the evaluation of the problem, subsequently carrying out the corresponding interpretation, until the establishment of the necessary precedents that determine the causality and its consequences. A questionnaire was applied to 6 Criminal Judges, Criminal Prosecutors, 5 Lawyers Specialized in Criminal Matters and 9 Police Officers specialized in investigating the crime of Trafficking in Persons. It is concluded that human trafficking seriously affects and violates Human Rights, which generally disturbs the majority of women, given that they are the most prone.
