    La nueva Ley 17/2021, de 15 de diciembre, de modificación del Código civil, la Ley hipotecaria y la Ley de Enjuiciamiento Civil, sobre el régimen jurídico de los animales ha modificado una serie de artículos de esas leyes. La idea fundamental de esta nueva ley es aclarar que los animales no son bienes muebles, que los animales no son cosas, aunque se les puede aplicar la normativa para los bienes muebles, siempre que las normas no sean contrarias a la naturaleza de los animales, ni perjudiquen su bienestar. La naturaleza es de seres sintientes, lo que se hace aún más evidente con las mascotas. Este estudio hace un análisis a través de todos los artículos que han sido reformados destacando las cuestiones que la reforma plantea.

    The new Law 17/2021, of December 15, modifying the Civil Code, the Mortgage Law, and the Law of Civil Procedure, about the legal regime of animals, has modified a series of articles of those laws. The fundamental idea of this new law is to clarify that animals are not movable property and are not things, although the regulations for movable property can be applied to them, provided that the regulations are not contrary to the nature of the animals and do not harm their welfare. The nature of animals is that of sentient beings, which becomes even more evident with pets.
