Delegados de prevención: conflictos entre el derecho de información y el deber de sigilo

    En este trabajo se realiza un análisis del conflicto que surge entre la facultad de información de la que gozan los delegados y las delegadas de prevención y el deber de sigilo que recae sobre dicha representación. Por un lado, el derecho de información constituye una facultad con la que cuentan los y las delegados de prevención, concretamente que se configura como básica para poder llevar a cabo sus competencias de forma efectiva y eficaz. Pero, por otro lado, la obligación de sigilo que les es exigida supone imponer una serie de limitaciones que pueden llevar incluso a desdibujar dicha facultad, impidiendo el cumplimiento de sus competencias y derechos como órgano de representación de las personas trabajadoras en materia de seguridad y salud laboral. De ahí, la necesariedad de analizar el deslinde entre estas dos instituciones jurídicas.

    In this work, it is carried out an analysis of the conflict that arises between the information faculty enjoyed by the prevention representatives and the duty of discretion that falls on said representation. On the one hand, the right to information constitutes a power that prevention representatives have, specifically that it is configured as basic to be able to carry out their functions effectively and efficiently. But, on the other hand, the obligation of secrecy that is required of them implies imposing a series of limitations that can even lead to blurring said power, preventing the fulfillment of its powers and rights as a representative body of workers in matters of health and safety at work. Hence, the need to analyze the demarcation between these two legal institutions.
