Resumen de La legitimidad de los actos administrativos electrónicos en el marco de las actuaciones administrativas

La presente investigación tiene como objetivo dar a conocer la legitimidad de los actos administrativos electrónicos en el marco de las actuaciones administrativas, para lo cual se aborda el tema por medio de un enfoque cualitativo, basado en el método hermenéutico, que permite dilucidar el alcance de los resultados de la investigación por medio de la interpretación de textos normativos, jurisprudenciales y doctrinales.
En ese sentido, partiendo de una revisión documental exhaustiva de fuentes bibliográficas confiables, se obtiene como resultado principal de esta pesquisa, que los actos administrativos electrónicos tienen la misma validez que los actos administrativos físicos, siempre que satisfagan los requisitos de autenticidad, integridad y disponibilidad, para efectos probatorios, tanto ante la misma administración como ante la administración de justicia, en el marco del principio de equivalencia funcional.

The objective of this research is to make public the legitimacy of electronic administrative acts within the framework of administrative actions, for which the issue is addressed through a qualitative approach based on the hermeneutical method, which allows elucidating the scope of the results of the research through the interpretation of normative, jurisprudential and doctrinal texts.
In this sense, based on an exhaustive documentary review of reliable bibliographic sources, the main result obtained of this research implies that electronic administrative acts have the same validity as physical administrative acts, provided that they satisfy the requirements of authenticity, integrity and availability for evidentiary purposes, both before the administration itself and before the administration of justice within the framework of the principle of functional equivalence.
