La aprobación de la LOMLOE ha causado una extraordinaria polémica en la comunidad educativa, y ha dado lugar a agrias reacciones en diversos sectores de la sociedad. Desde el punto de vista jurídico, son muchos los interrogantes que se ciernen sobre esta norma. En el presente trabajo, la atención se centra en uno de los aspectos más problemáticos de la LOMLOE, a saber, la regulación de los conciertos educativos. El autor trata de mostrar que la aprobación de la ley supone la ruptura del consenso educativo acordado por el Constituyente. A través de diversas disposiciones, articula un asedio a la escuela concertada difícilmente compatible con las libertades educativas.

The approval of the LOMLOE has given rise to an enormous controversy within the education community, and has aroused bitter reactions among different sectors of society. From a legal point of view, there are many unsolved questions hanging over that norm. In this work, the attention is focused on one of the most problematic aspects of the LOMLOE, namely, the regulation of the educational subsidies. The author attempts to show that the approval of the law marks a breakdown of the educational consensus agreed by the Constituent. Through several provisions, the LOMLOE articulates a siege against the subsidized schools which is hardly compatible with the educational liberties.
