Una ley que rompe consensos: la LOMLOE escoge el camino equivocado

    En este artículo se repasa la tramitación y elaboración de la última reforma de la legislación educativa en España. Si bien hay algunos aspectos positivos en la Ley, existen otros elementos de dudosa constitucionalidad. La tesis que se defiende en el texto es que la Ley persigue abandonar el principio de complementariedad de la oferta estatal y la concertada, intentando promover uno de subsidiaridad de la concertada con respecto a la estatal. Se rompe así el equilibrio establecido en el artículo 27 de la Constitución. Además, hay otros aspectos que pueden considerarse inconstitucionales, como la prohibición de la financiación de los centros educativos que optan por el modelo pedagógico de la educación diferenciada, o el tratamiento de la lengua castellana y las lenguas cooficiales.

    This article reviews the processing and drafting of the latest reform of education legislation in Spain. Although there are some positive aspects of the Law, there are other elements of dubious constitutionality. The thesis defended in the text is that the Law seeks to abandon the principle of complementarity between state and state-subsidised education schools, in an attempt to promote one of subsidiarity of state-subsidised schools with respect to state schools. This breaks the balance established in Article 27 of the Constitution. In addition, there are other aspects that could be considered unconstitutional, such as the prohibition of funding for schools that opt for the pedagogical model of single-sex education, or the treatment of the Spanish language and the co-official languages.
