    In tema di rinnovazione delle prove dichiarative in caso di overturning sfavorevole all'imputato, ora prevista dall'art. 603, comma 3-bis, c.p.p., la giurisprudenza della Corte di cassazione ha affermato principi che vanno oltre il rispetto delle garanzie richiesto dalla Corte EDU. Gli Autori si chiedono, alla luce anche di alcune recenti pronunce dei giudici di Strasburgo, se su taluni aspetti (in particolare: scelta del rito abbreviato, tutela del teste vulnerabile) possano aprirsi nuovi scenari.

    As regards the renewal of the trial evidentiary hearing in the event of overturning of the acquittal on Appeal, now laid down in Art. 603 Para. 3-bis c.c.p., the Court of Cassation jurisprudence has stated principles going beyond the respect of the guarantees requested by the ECtHR. The Authors wonder, also considering some recent judgements of the Strasbourg Court, whether new scenarios may open up on certain issues (in particular: choice of “giudizio abbreviato”, vulnerable witness protection).
