Resumen de La Corte Interamericana de Derechos Humanos y su interpretación sobre la Constitución Política de Colombia a la luz del poder punitivo del Estado y de su potestad sancionadora

Hay una controversia constitucional que surge de la injerencia que realiza la Corte Interamericana de Derechos Humanos como órgano que interpreta la Convención Americana de Derechos Humanos frente a la labor de la Corte Constitucional de velar por proteger la integridad de la Constitución. Teniendo en cuenta la labor de la jurisprudencia del Sistema Interamericano de Derechos Humanos sobre la potestad de los Estados parte de limitar derechos por medio de la potestad sancionadora del Estado y su ejercicio del poder punitivo, el siguiente trabajo pretende determinar si la Corte Interamericana de Derechos Humanos puede como órgano de Derecho Internacional, ejercer un control externo sobre la Constitución Política. Esto se hará, por medio del análisis de una concepción del control limitado que ejerce la Corte IDH sobre preceptos constitucionales.

Due to the role of the Inter-American Court of Human Rights as the interpreter of the American Convention of Human Rights towards the role of the Colombian Constitutional Court as the interpre ter and protector of the Colombian Constitution in its integrity, a controversy arises in the area of Constitutional Law. Through the rulings of the Inter-American Court of Human Rights on the prin ciple of sanctioning powers and the punitive power of the State, this article seeks to determine whether the Inter-American Court of Human Rights is able, as an international law body, to review the Colombian Constitution. The article will fulfill this objective throu gh the analysis of the limited review the Inter-American Court of Human Rights on the articles of the Constitution that limit rights or liberties given by the American Convention of Human Rights.
