Inconstitucionalidad de la cadena perpetua en Colombia

    "El 22 de julio de 2020 se aprobó el Acto Legislativo 1 de 2020 “Por medio del cual se modifica el artículo 34 de la Constitución Política, suprimiendo la prohibición de la pena de prisión perpetua y estableciendo la prisión perpetua revisable”. Por considerar que esta norma sustituye la Constitución Política de 1991, algunos integrantes del Semillero en Derecho Penitenciario de la Pontificia Universidad Javeriana presentaron una demanda de inconstitucionalidad, la cual fue admitida por la Corte Constitucional mediante auto del 28 de septiembre de 2020 (expediente D-13839). El presente artículo contiene los argumentos de dicha demanda, en donde se señala que el legislador incurrió en una sustitución de los principios fundantes sobre los que se erige nuestra norma de normas, como son la dignidad humana (artículo 1° constitucional) y la posibilidad de resocialización (artículos 10-3 del Pacto Internacional de Derechos Civiles y Políticos y 5-6 de la Convención Americana de Derechos Humanos), la igualdad (artículo 13 constitucional), la libertad y la prohibición de imprescriptibilidad de la penas (artículo 28 constitucional)."

    "On July 22, 2020, Legislative Act 1 of 2020 was approved “By means of which article 34 of the Political Constitution is modified, eliminating the prohibition of life imprisonment and establishing reviewable life imprisonment.” Considering that this rule replaces the 1991 Political Constitution, some members of the Penitentiary Law Group of the Pontificia Universidad Javeriana, presented a claim of unconstitutionality, which was admitted by order of September 28, 2020 (file D-13839). This article contains the arguments of our claim, where we point out that the Legislator incurred in a substitution of the founding principles on which our Constitution built, such as human dignity (Article 1 of the Constitution) and the possibility of re-socialization (Articles 10-3 of the International Covenant on Civil and Political Rights and 5-6 of the American Convention on Human Rights), equality (Article 13 of the Constitution), freedom and the prohibition of the imprescriptibility of penalties (Article 28 of the Constitution)."
