This intervention aims to systematically reconstruct the probative relevance of the anomalous declarative sources, which are the most controversial, hermeneutically, of the criminal procedural system. Therefore, the statements made by the people offended by the crime, the self-indicative statements, the statements made by the collaborators of justice, the statements made by the untraceable witness and, lastly, the statements made by the expert witness were examined. Each of these trial figures is examined in the light of the most recent jurisprudential interventions of the Court of cassation, in the broader context of the principles affirmed by the European Court of Human Rights.
Questo intervento si prefigge l'obiettivo di ricostruire sistematicamente la rilevanza probatoria delle fonti dichiarative anomale, che sono quelle più controverse, sul piano ermeneutico, del sistema processuale penale. Si sono, pertanto, esaminate le dichiarazioni rese dalle persone offese dal reato, le dichiarazioni auto-indizianti, le dichiarazioni rese dai collaboratori di giustizia, le dichiarazioni rese dal testimone irreperibile e, per ultimo, le dichiarazioni rese dal testimone esperto. Ciascuna di queste figure processuali viene esaminata alla luce dei più recenti interventi giurisprudenziali della Corte di cassazione, nel più ampio contesto dei principi affermati dalla Corte europea dei diritti dell'uomo.
