    Este trabajo da respuesta a la pregunta de si es requisito previo el informe de insuficiencia de medios en los contratos menores de servicios, a que se refiere el artículo 116 de la LCSP, en la preparación y tramitación del expediente administrativo. Aunque también cabría entender la pregunta orientada a si entre la obligación de motivación de la necesidad del gasto debe estar acreditada la motivación de dicha insuficiencia de medios, dado que al fin y al cabo el resultado sería idéntico.

    This paper answers the question of whether the report of insufficient resources in minor service contracts is a prerequisite, referred to in article 116 of the LCSP, in the preparation and processing of the administrative file. Although it would also be possible to understand the question oriented to whether the obligation to state reasons for the need for the expense should be proven to state the reasons for said insufficiency of means, since in the end the result would be identical.
