Aporofobia y derecho penal: el delito de hurto y la circunstancia agravante de multirreincidencia

    En este trabajo se someten a examen algunos elementos relativos al delito de hurto en el Código penal español. Primeramente, se analiza la evolución que la regulación ha venido experimentando en los últimos años. En concreto, se estudian las modificaciones introducidas por las Leyes Orgánicas 11/2003, 15/2003, 5/2010 y 1/2015. Tras ello se analiza someramente la circunstancia agravante de multirreincidencia y su desarrollo jurisprudencial, circunstancia introducida por la Ley Orgánica 1/2015. El trabajo finaliza con unas conclusiones de carácter crítico en las que se plantea el abandono del endurecimiento punitivo que ha venido adoptándose progresivamente con cada reforma del Código penal y en su lugar se propone la adopción de otro tipo de respuestas que contribuyan de manera más eficaz a la prevención y a la no repetición de estas conductas

    In this work, some elements related to the crime of theft in the Spanish Penal Code are examined.

    First, the evolution that the regulation has been experiencing in recent years is analyzed. Specifically, the modifications introduced by Organic Laws 11/2003, 15/2003, 5/2010 and 1/2015 are studied. After that, the aggravating circumstance of multiple recidivism and its jurisprudential development, a circumstance introduced by Organic Law 1/2015, is briefly studied. The work ends with some critical conclusions in which the abandonment of the punitive hardening that has been progressively adopted with each reform of the Penal Code and the adoption of other types of responses that contribute more effectively to prevention and non-repetition of these behaviors are proposed.
