  Este trabajo somete a examen la necesidad de incluir la aporofobia entre los motivos discriminatorios constitutivos de agravación. Para ello se analiza, por un lado, el subtipo cualificado por razón de la especial vulnerabilidad de la víctima previsto en doce preceptos del Código penal y, por otro lado, la circunstancia genérica de abuso de superioridad. En particular, se examina el fundamento que justifica cada una de estas agravantes y se presentan los resultados de un análisis jurisprudencial llevado a cabo para determinar los casos en los que se han aplicado en contextos de sinhogarismo.

  This paper examines the need to include aporophobia among the discriminatory grounds that constitute aggravation. To this end, on the one hand, it analyses the qualified subcategory due to the special vulnerability of the victim provided for in twelve provisions of the Criminal Code and, on the other hand, the generic circumstance of abuse of superiority. In particular, it examines the basis that justifies each of these aggravating factors and presents the results of a jurisprudential analysis carried out to determine the cases in which they have been applied in homelessness settings.
