Con la STC objeto de análisis, la práctica totalidad de la Ley Foral 21/2019, de 4 de abril, de modificación y actualización de la Compilación de Derecho Civil de Navarra o Fuero Nuevo ha logrado pasar el listón constitucional poniendo así fin a una controversia de carácter competencial relacionada con el art. 149.1.8 CE, que atribuye al Estado competencia exclusiva en materia de legislación civil, “sin perjuicio de la conservación, modificación y desarrollo por las Comunidades Autónomas de los derechos civiles, forales o especiales, allí donde existan”.
According to the Constitutional Court ruling that is under analysis in this article, almost the totality of the provisions in Navarra’s Regional Law (Ley Foral) 21/2019, of 4 April, that deals with the amendment and the updating of the Compilation of Navarra’s Civil Law (also known as “Fuero Nuevo”) have been considered as consistent with the Spanish Constitution; this puts an end to the long standing controversy on competencies that is related to Article 149.1.8 of the Spanish Constitution, according to which the state has exclusive competence in relation to cicil law, “without prejudice of the preservation, amendment and developments by the Autonomous Communities of civil rights, ‘foral’ or special rights, wherever these might exist”.
