    La reforma operada por la Ley orgánica 1/2015, de 30 de marzo, ha introducido importantes modificaciones en los delitos contra la flora silvestre. Entre ellas, la sustitución de un objeto material definido como “especie amenazada” por el más amplio e impreciso de “especie protegida”, con la consiguiente merma de garantías en sede de ofensividad. En este contexto resulta imperativo el análisis de las consecuencias asociadas al nuevo tenor del art. 332 C.P., superando posibles déficits lesivos mediante una exegesis respetuosa con el significado de ultima ratio del Derecho penal, pues la deficiente redacción de alguno de los elementos del delito, cuya oportunidad es más que discutible, genera problemas que trataremos de poner de relieve con este trabajo, también desde la perspectiva de nuestras obligaciones supranacionales.

    The reform implemented by the Organic Law 1/2015, of March 30, has introduced important modifications in the offences against wild flora. Among them, the replacement of a material object defined as “threatened species” by the broader and more imprecise one of “protected species”, with the consequent reduction of guarantees in terms of offensiveness. In this context, it is imperative to analyse the consequences associated with the new wording of art. 332 C.P. in order to overcome possible deficiencies of harmfulness by means of an exegesis that fully respects the ultima ratio meaning of criminal law. The deficient wording of some of the elements of the offence, whose appropriateness is more than debatable, generates problems that we will try to highlight in this paper, also taking into account the perspective of our supranational obligations.
